## Backstory

A lot of sacrifices were made to come home and help take care of my grandmother, who had Alzheimer. To say the least, it was some difficult times, and it has taken a lot to go through. Having grown up here, and having it as a steady point in my life, has been a blessing I am unworthy of. During those years caring for my grandmother, I grew very fond of the place, and of all the memories that took place there. After her passing, it became quite clear, all that is left of my family is my mother and our home. I was raised believing it is a man's sworn duty to defend his home and his family, and what you will see here is exactly that, a man fiercely defending his family.

------------------

## Communication between the Zoning Administrator

All communication between Lamar County's Zoning Administrator occurred over the following emails, except for one solitary phone call that occurred a year or two prior. The contents of that phone will be discussed below, and all emails will follow.

### The Phone Call

The phone call was concerning the amount of construction work that was occurring on a property across the street from our home. Technically speaking, the land was being cleared by an individual who had submitted an accepted offer on the property, but in real estate terms the sale had yet to close, meaning the deed of ownership was still in the original owner's possession, and it technically was not his at the moment. The volume of heavy machinery work occurring on that property was truly something never seen before, and the size of some of the equipment was later discovered to be the largest available.

Having formal training in landscaping from one of the best schools for it in the state, I was already aware there was a limit to how much land you could clear without obtaining some form of permit from a governmental authority. In fact, I remember the information came as quite a surprise when mentioned in class. I was also aware measures were required by law to prevent soil erosion from occurring on the property. As good as it is to protect our natural resources, erosion prevention is just as much about avoiding being held liable than anything else.

I called the Zoning Administrator, informed her about the situation, and related to her that the amount of heavy machinery work occurring on the property made it unclear if the property owner was building a home or an open pit mine. I asked her about the aforementioned laws requiring permitting and erosion protection, and she told me they did not exist. That the person can clear as much ground as they want without permitting, and there were no state laws requiring erosion protection.

There was no doubt at the time, either my instructors at school had gotten it wrong or the zoning administrator got it wrong, and it didn't take long to figure out the Zoning Administrator was terribly mistaken.

### The Email Compendium

The entirety of emails with the zoning administrator is provided in redacted form within the documents folder and is labeled [zoning_administrator_emails](/anita_emails-redacted.pdf), below is an overview and summation of the key aspects of these documents.

When all this started, we were hesitant to draw conclusions, and even more hesitant to believe the conclusions we drew. Regardless of being the most probable and/or reasonable explanation, we had the foreknowledge to know our conclusions would not be easy for others to accept, and even more difficult to prove.

Regardless, early on we experienced an inordinately difficult time with getting anything published in either of the local news publications and with acquiring legal help for the situation we were catapulted into. Admittedly this difficulty may just be a consequence of bad timing or poor luck, so we don't take either too seriously, but the difficulty was so unusual it eventually rose to suspicions of being blacklisted as a result of the smear campaign logged against us.

### Legal Counsel

The attacks launched against our family's property and our family have remained from the beginning, suspect of being planned and orchestrated with advisement and full cooperation of legal counsel. This was first evident when reviewing the state legal code regarding selling real estate without a realtor's license. When the statutes were compared against the list of excuses provided by the Fire Chief for his involvement in the dissolution of a former neighbor's estate, it became suspect that the Fire Chief had been coached by an attorney as to what he should say to avoid being held negligible for his actions. As events unfolded, all appeared to be planned in advance and with counsel from a legal advisor. Normally, there is nothing wrong with this, but since the intent was not to protect the rights of clients whom desire to avoid unintentional acts of negligence, and instead ensure clients intentionally persecuting the rights of another avoid and evade being held accountable for performing irreparable harm. Providing counsel in this manner would be considered unethical conduct by a servant of the court. Especially if such counsel was fully aware that the result of which would violate the law and constitutional rights granted to another.

Furthermore, our experience acquiring qualified legal counsel has raised significant suspicion in its own right. As a result of the persecution, we have had a significant amount of legal issues forced upon us, several of these issues lay in different fields of legal study, and two of our largest issues lay in different practices of law altogether, yet regardless of which issue we sought counsel for we have encountered nothing but difficulties obtaining proper counsel. Twenty-five attorneys were chosen and were reached out to for legal assistance, 92% of these attorneys simply did not respond, out of the remaining 8% only 2 were helpful. Which is astonishing from a statistical standpoint.

### News Media

We have contacted numerous news agencies in the area, some of which we have tried to make contact numerous times, and all of which resulted in no response ever being given. Almost all of these news agencies are owned by the same investment group which local news editor Walter Geiger is a member of. We have tried to contact him directly with our story, without reply.

In the past, "The Barnesville Dispatch", which was formerly owned and operated by the late Greg Williams, who was charitably generous and supportive to what the county was putting our family through, and we were in contact with Mr. Williams before his passing regarding the tribulations our family was undergoing. Unfortunately, after Mr. Williams' death, the discourse with the dispatch fell silent, and repeated attempts to contact anyone at the dispatch were never responded too. This silence lead us to believe the online publication had stopped production altogether, and there was confusion over whether the paper was still in operation, and who was operating it. Since we discovered the online newspaper was still in operation, we have tried to make contact with them. Sometimes forwarding them articles already written, and sometimes explaining the importance of what we are submitting. These resulted in no response.

Before you dismiss the claim too quickly, consider headlines such as "local deputies raid wrong house over falsified accusations" and "County ignores millions of dollars in building violations out of political favor". Such headlines would be considered by anyone as newsworthy, and would sell newspapers, yet they were factually based and routinely ignored by the local news media.

## Intro
> [!important] What is Potential Revenue?
> **Potential Revenue** - is revenue (money/income/capital) that **Could** be earned. This means there is an opportunity to make money.
>
> **Unclaimed Potential Revenue** - is Potential Revenue that was ignored. This means there was an opportunity to make money, and it was not done.
### To Start with:
- We do not believe the county is enforcing any of the construction statutes on the federal, state, and local county level.
- This is costing local taxpayers millions in unclaimed potential revenue.
- This is also illegal, as counties are legally obligated to honor state and federal law.
- Disregarding the law leads to chaos and loss.

> [!info] What are Legal Fines?
> Legal fines are penalties for breaking the law.

### Basic Logic: How unclaimed potential revenue affects you.

It takes money to run the county. There are two places where the county can get money:
1. The Taxpayer (You)
2. Legal fines (People who break the law)

__Straight forward:__
If the county *cannot* get money from legal fines, then it will need to get it from taxpayers.

__Now, in reverse:__
If the county *can* get money from legal fines, then it will not need to get it from taxpayers.

__Put it together:__
If the opportunity to make money is there and the county does not do it, then you will have to pay more money.

## How much money?

Without question, millions. For a better understanding we have provided an estimate of the unclaimed potential revenue for one subdivision we have been monitoring.

### Kardun Homes Subdivision

We are not aware of all violations performed by the developers of this project. Here we are only listing the violations that we know of. The actual amount would be exponentially higher.

Since the county has formally refused to enforce any law regarding building and construction practices, we place the duration for these fines to accumulate at the statutory limit for litigation. Which is believed to be 2 years or 730 days.

| Violation | Property | Amt per day | Days | Unclaimed Potential Revenue |
| ---------------- | -------- | ----------- | ----- | --------------------------- |
| No Permit | Parcel 1 | 1500 | 730 | 1095000 |
| Soil and Erosion | Parcel 1 | 2500 | 730 | 1825000 |
| No Permit | Parcel 2 | 1500 | 730 | 1095000 |
| Soil and Erosion | Parcel 2 | 2500 | 730 | 1825000 |
| Soil and Erosion | Parcel 3 | 2500 | 730 | 1825000 |
| Soil and Erosion | Parcel 4 | 2500 | 730 | 1825000 |
| Soil and Erosion | Parcel 5 | 2500 | 730 | 1825000 |
| Soil and Erosion | Parcel 6 | 2500 | 730 | 1825000 |
| | | | Total | 13140000 |

From this table, we can see that just from fines for violations of the federal soil and erosion statutes, the developer has generated $10,950,000 in unclaimed revenue for the county. That is a heck of a lot of money, and the county is making you pay for it instead of fining the developer.

In the spirit of full disclosure, we stopped keeping a detailed account when the county clarified its intent to completely disregard the law. At that time two projects had reached $736000 but we have since estimated the current amount of penalties for one of those projects to be a minimum of $840,000. You could easily multiply that by three, and still come short of the actual amount of penalties accumulated by the development performed by the Tyler/Simmons family. A more realistic expression would be exponentially higher, considering one violation entails a $2500 fine per day, for each day the violation continues. Not only did the developer never acknowledged the violation or invest any effort into rectifying the violation, the Zoning Administrator's refused to enforce state and federal law, which neither nullifies the existence of the violation, nor does it grant any special rights for its violation.

| Property | Est. Start | Days | Violation | Fine Amount | Total |
| --------- | ---------- | ---- | ---------------------------- | ----------- | ------- |
| 754 M.RD | 02/2020 | 730 | Fed. Erosion and Soil Prot. | 2500 | 1825000 |
| 743 M.RD | 05/2022 | 730 | Fed. Erosion and Soil Prot. | 2500 | 1825000 |
| 723 M.RD | 10/2023 | 210 | Permit Vio + Fed Soil + Ero. | 4000 | 840000 |
| **Total** | | | | | 3847500 |

### Is the county honoring any statute codified in law?

When asked if the county is monitoring any of the construction sites for violations, as it should according to its own county ordinance, the Chairman of the County Commissioners responded "We do not have enough resources for that". Which upon review it appears the opposite is true, how can the county afford not to enforce ordinances. Regardless, the statement says nothing about not refusing to enforce known, and even self admitted violations. From a general survey of the numerous construction sites across the county, it appears the county is not enforcing any of the building or construction statutes codified into law by itself, the state, or even congress. It simply is refusing to enforce any law that would prohibit illegal building practices, but it will enforce any ordinance that it sees fit as to punish political dissenters.

### This IS the county's policy

The refusal to enforce building and construction statutes is a remnant of old neoconservative political thought. Which mistakenly believes that by promoting the interests of big business over the private liberties of the average citizen, the end result would be a productive and stable economy. The most obvious problem with this is the assumption private liberties are less worthy than the interests of big business. After all, governing the early American colonies before the revolutionary war was "big business" for the crown, and it is due to this inability of private liberties to compete with those of "big business" which we revolted. Thus is the reason our founding father's labeled these private liberties as inalienable rights, meaning they are inseparable from mankind.

When the prioritization of protecting the private investments of average consumers in location dependent assets are demoted below the interests of big business to increase profitability, the consumer will hesitate to further invest in those location dependent assets in order to cover losses and protect capital. This will in turn reduce the gross domestic product of the area for location dependent assets, and as producers of those goods and services experience less and less demand for their product or service they will have to scale back the rate of production and/or raise prices in order to satisfy costs of remaining in business. This will in turn reduce the amount of capital available for further investment in goods and services.

## The curious case of Chief Matthew's private road

We do not know exactly what was going through Chief Matthews' mind when he decided to build a private road through the middle of his neighbor's property, why he felt it was acceptable, or why he even needed to be done in the first place. What we do know is his neighbors informed us that permission was not granted for him to do so, and they were lead to believe he was only going to move one piece of equipment one direction only once.

Currently, it has been four years since the road's construction, it has never seen a stop in use. All the promises Chief Matthews had made to the landowner were never fulfilled, and obviously the story he told to the landowner was not truthful. Not only has he practically ruined someone else's property, he has considerably destroyed the market appeal of the property.

Matthews is recently separated. The road begins at his house and ends at the home owned by the widow of one of his firefighters. It obviously has seen use as nothing has been able to grow back from it's clearing, and the landowners have complained about hearing traffic on it late at night.

## [Letter to the editor of The Barnesville Dispatch](https://barnesvilledispatch.com/index377.htm)

### The Analogy

What if a new neighbor asked if he could borrow a particularly rare and expensive piece of equipment? You are not familiar with this person, who has only just moved into the house next door a few weeks prior. The cost to replace the particular piece of equipment is around $8500, but he does promise to return it to you when finished. How would you respond?

Generally, there are three responses to this type of question. One being a polite yet definitive, no. Which understandably, is the most popular response. After all, you do not know this person, and the equipment is very expensive. A less definitive, but more subtle response, would be to respond with you were using it at the moment. Which is true, you were using it to hold onto the ground. Lastly, the saintly but more risky affirmation of, yes.

Assuming that you did say yes, what would you expect to happen? When would you expect to have the equipment returned to you, and in what condition? Instinctively, because of how the neighbor mentioned returning the equipment upon completion, you would naturally assume that it would be returned momentarily. At most, one or even two days. Since its use would only be for a moment, one would expect it to be returned to the exact shape, if not better shape than it was before. This is after all the decent thing to do.

Unfortunately, in our hypothetical situation, your expectations did not come to fruition, your new neighbor did not return your prized equipment for over six months, and when it was finally returned, you found it completely demolished. Then your neighbor let it slip he had the exact same piece of equipment all this time, but just preferred to use yours.

### The Reality

The above scenario is an analogy, but something nearly identical happened to an extremely kind family nearby. The mother and father had found themselves in extremely poor health in the later part of their life, and even their son is in diminished health. At the time, the father could barely move due to difficulties with terminal cancer. The couple's primary asset in life was their land, which they had already passed over to their son as inheritance. No one in the family was capable to traverse through the heavy brush of the property they lived on, which had been recently timbered.

One day, the family was approached by a new neighbor, someone they just recently met, and inexplicably the neighbor asked if he could move a piece of equipment across their land. At that time, every waking moment of their existence was dedicated to the welfare of a terminally sick family member, nothing else mattered to them, so they allowed it instead of asking why he couldn't use road.

Around a month or so later, the new neighbor approached them again, and went a little further by asking if he could move some stuff out of the way to get the equipment through. This was a red flag for them to inquire why the logging path could not be used, but the health of their loved one had taken a critical turn for the worse, they didn't want to be bothered with it, and told him whatever he wanted to hear. The customary empty promises were made to put things back and close off any entrance. The neighbor had gotten what he wanted and was on his way.

Six months later the family discovered the new neighbor had built himself a rather nice private road through the back of their land. It was used regularly by heavy machinery, sat at the bottom of a hill obscured from view, and was cut directly through their land connecting the new neighbor's property with an adjacent lot. The road was clear-cut, graded, and appeared to have had an application of topsoil. In order to clear it, trees were toppled, massive boulders weighing hundreds of pounds were moved, and sections of the hill were completely dug out. It is exactly the last thing anyone would want someone else to do to their property.

### Analysis

The new neighbor only had permission to move a solitary piece of equipment once, in one direction. Permission was never given to construct a private road, use it repeatedly, or without knowledge of the owner. Payment or compensation was never offered for its use, and no reimbursement was offered for the damage done. To this day, the new neighbor he has never even acknowledged its existence to the couple, and surely has never apologized for taking advantage of their courtesy, because he felt justified in his actions.

Admittedly, why the new neighbor built the road to begin with makes little sense. The now joined property can easily be reached by public road, which was more accessible for use. Then there is the preexisting path created by the logging company that runs parallel, follows the exact same as the private road. The only difference in the two being, the path cut by the logging company sits on top of the hill and is visible. Where the new neighbor's private road sits at the bottom of the hill and is obscured from view. Regardless of this difference in visibility, there was no real reason for a new road to have been built. That is, unless, it was built in order to dissuade the couple from selling their land to anyone else, by effectively diminishing the value of it to potential buyers.

### Historical Precedence

On numerous occasions, the new neighbor has insinuated to the couple they were too old to live where they do, and has offered to place them in an apartment in exchange for their land. What is not mentioned, is who is going to make payment on rent for this apartment, or if the apartment is going to be as comfortable as the place they have called home for well over twenty years. So, there is a verbal-expressed interest in moving the couple out in order to acquire the land. Also, having been caught poaching the same year he arrived, we know he has no problem trespassing when it suits his interest as well.

Furthermore, how the new neighbor came to be is suspicious in its own right. As the previous owner of the residence simply disappeared, and the new neighbor was discovered, already moved in without any indication of what had happened to the previous owner. Rumor has it, the previous owner was placed in a nursing home after relinquishing over his property to the guy, and before actually owning it, the new neighbor had promised part of it to one of his buddies in exchange for "favors".

### Closing

The fact is, some people work on the beliefs, "it is better to ask for forgiveness, than permission" and "Everything is legal as long as you don't get caught". It is something that we all must watch out for, because not everyone functions with the same value system as ourselves. To some this is unconscionable, to others it is a way of doing business.

As of today the entrance to this private road has never been closed, nor has anything been put back, and what is left is a mess no one really wants or asked for. It is still suspect of use, and prevents the couple from being assured no one is using their land without their permission. Which might have been one of the new neighbors intentions, we do not know. What we do know is the couple will endure a difficult time if they ever decide to sell the land. As, not many people are interested in land with someone else's private road across it.

Below are only the videos we were able to upload to Rumble. One other video was uploaded to the tube of you, and several others have yet to be publicly available.

### Dessimation of Antebellum Homestead

This video was taken after the county Fire Chief brokered the land across the street to one of his fellow volunteer firefighters. It had to have been the location of an antebellum farmstead, as not only were there rock reinforced terraces, there was even a set of rock steps. The new owner was informed of this, and proceeded to bulldoze right through it. He even went as far as excavating all the massive boulders from the site that had reinforced the terraces for over 100 years, and used a hydraulic jack to pulverize them. He literally carved half the hilltop out and flipped it on top of itself. It was three months of heavy machinery work, and it destroyed whatever was there. The county Fire Chief took several days off work to help. It signaled the end of any privacy our family had enjoyed after living in the area for 55 years. Then the new owners of the property began harassing our family before they had even finished clearing the land.

### Neighbors Stalking

As mentioned above, since before they finished clearing the woods across the street from our home, the new owners of that property have harassed, stalked, and tried to intimidate our family. The only reasonable explanation for this is were told to do so by the county Fire Chief and his relative, Mr. Brian Alex Abernathy. Both have targeted our family since we opposed the solar power plant. This, and this alone, is the only offense that can be justified to hold against us, outside of this is just purely being hateful.

I apologize for the quality of the audio, if there is any. The cameras used to shoot this are quite a distance away, and only have the smallest of microphones to receive sound from. Most of the time, the sound is simply disabled during video processing in order to conserve the processing power of the older computers used to process them.

<iframe class="rumble" width="640" height="360" src="https://rumble.com/embed/v4j76ec/?pub=4" frameborder="0" allowfullscreen></iframe>

### Stalking the second weekend

Anyone could have guessed the stalking was just bound to happen again the following weekend, and after being shadowed by Brent McDaniel on a motorcycle for over twelve minutes, we called local law enforcement to handle the issue.

<iframe class="rumble" width="640" height="360" src="https://rumble.com/embed/v4k5q9h/?pub=4" frameborder="0" allowfullscreen></iframe>

### Third Weekend of Stalking

You can't knock them for trying. This third and final video is the entirety of the incident where Ron Simmons tried to intentionally antagonize us by picking a fight.
